1. Agreement

By using margolickai.com or our services, you agree to these Terms of Service. If you do not agree, do not use our services.

2. Services

Margolick AI provides AI-powered automation services for small businesses, including missed-call text back, lead capture, and automated follow-up. Specific services and deliverables are defined in each client agreement.

3. Accounts and eligibility

You must be at least 18 years old and authorized to conduct business to use our services. You are responsible for maintaining the confidentiality of any account credentials.

4. Payments

• Setup fees are due before services begin and are non-refundable unless otherwise stated in your service agreement.
• Monthly fees are billed in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period.

What we do commit to: the work is built inside your own accounts under your own login, you own it, and you can take it with you. Scope is agreed in writing before any work starts. Your individual service agreement governs deliverables and timelines.

5. SMS and communications

If our services involve sending SMS messages on your behalf to your customers, you are responsible for ensuring you have obtained all consents required from your customers under the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and all applicable laws. We provide tools. You are responsible for lawful use.

6. Acceptable use

You agree not to:

• Use our services for illegal purposes
• Send unsolicited commercial messages to individuals who have not consented
• Violate any applicable laws or regulations

7. Intellectual property

We retain ownership of our systems, software, and methodologies. Work product we create specifically for you under a service agreement is governed by that agreement.

8. Limitation of liability

To the maximum extent permitted by law, the total liability of Margolick AI to you for any claim arising from or related to these Terms or our services is limited to the fees you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Disclaimer of warranties

Our services are provided "as is." We do not warrant that our services will be uninterrupted, error-free, or produce any specific business results beyond what is stated in your service agreement.

10. Termination

Either party may terminate a service agreement with 30 days written notice, unless your agreement specifies otherwise. We may terminate immediately if you violate these Terms.

11. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes will be resolved in the courts of Burlington County, New Jersey.

12. Changes to these Terms

We may update these Terms. Continued use of our services after changes constitutes acceptance of the updated Terms.
